Financial hardship can happen to anyone. We know because our firm has represented hundreds of borrowers facing foreclosure by their lenders. Many times borrowers are willing to make payments, but the lender does not accept them.
Often, the best defense is a good offense. When mortgage lenders make mistakes, act irresponsibily or act malicioulsy, we seek to hold them accountable and secure the restitution and opportunites owed to our clients.
Many borrowers are unaware of their rights, and also of the most common violations of Federal regulations and Florida statutes that lenders commit. Such offenses can offset the money owed to the lender; eliminate their right to foreclose; entitle the borrower to rescind the loan; and/or require the lender to pay money to the borrower.
Rather than engage in lengthy litigation, our clients often ask us to help them modify the interest rate and/or the principle amount owed to the lender. In situations where we expose the lender's liability, modifications are likely to occur. However, we have been successful at negotiating interest rate reductions and loan forgiveness when lenders are without fault, and even when the borrower has not yet defaulted on their loan.
